The ruling is a win for the Biden administration, which sued the state over floating barriers criticised by Mexico.

The judge gave Texas until Sept. 15 to move the barrier to shore and barred the state from placing any additional buoys or other structures in the river. Gov. Greg Abbott plans to appeal the ruling.

The Texas Military Department isn’t identifying the Guard member or providing details about the Saturday shooting. The man who was shot in the leg said he was working out near the river.

In a court hearing over the barrier near Eagle Pass, the U.S. Justice Department argued it was installed without federal authorization, while lawyers for the state said it notified the proper authorities.

The DOJ heads to federal court in Texas on Tuesday to challenge the state’s latest effort to implement its own border security measures.
