The assailant, an alleged MS-13 gang member who was in the country illegally, should never have been allowed entry in the first place. Nobles revealed that immigration officials failed to make a simple phone call that would have uncovered the assailant's criminal background and gang affiliation. Despite being listed as an MS-13 gang member in El Salvador, he was allowed to enter the United States unchecked. The Homeland Security Committee chair, Chairman Mark Green, expressed his disappointment that Secretary Mayorkas did not attend the hearing to hear Nobles' heart-wrenching testimony firsthand, highlighting that Mayorkas had disregarded laws passed by Congress and court orders.

In response to her daughter's tragic murder, Nobles called for not only stricter border policies but also for the impeachment of Secretary Mayorkas, holding the Department of Homeland Security (DHS) accountable for the failure to protect citizens. Criminal defense attorney Brian Claypool, who joined Nobles, emphasized the urgent need for DHS to fulfill its duty of safeguarding the nation's borders. Claypool further pointed out that DHS had catastrophically failed by neglecting even the most rudimentary measures, such as checking for gang-related tattoos and making a simple phone call to the consulate.

In light of this devastating incident, Nobles and Claypool have embarked on filing the first-ever wrongful death lawsuit against DHS. They argue that the agency's negligence directly contributed to Kayla Hamilton's tragic demise, as they failed to identify her murderer as a threat and ensure his proper prosecution. They also criticized the Department of Health and Human Services (HHS) for allowing the assailant to be placed with a non-relative sponsor and later escaping to rent a room with Kayla.

Nobles recounted the chilling sequence of events leading up to her daughter's death, describing the struggle Kayla faced as she fought for her life. Calling for justice, Nobles stated that if DHS had done its job, her daughter would still be alive, enjoying the milestones of adulthood like getting married and having children. Both Nobles and Claypool emphasized the urgent need to hold the federal government accountable, believing that, without intervention, similar tragedies will continue to occur.

As the lawsuit against DHS proceeds, the nation is left grappling with an unnerving realization that preventable failures in border security have irreversible consequences.
