Young thug who smashed man's face with empty MD 20/20 bottle tells court it "plays on his mind"

A young thug who robbed a man at a bank machine and smashed his face with an empty Mad Dog 20/20 bottle claimed that incident “plays on his mind.”

Finlay Main brutally assaulted Kyle McKendrick in Linwood’s Clippens Road in March last year and demanded that he gave him money.

Main, 18, smashed an empty bottle of booze over McKendrick’s face, robbed him of £70 and then went on to make a catalogue of offensive homophobic and racial remarks to police officers in Paisley's Royal Alexandra Hospital.

After “careful consideration,” Sheriff Tom McCartney took a step back from custody, having previously warned Main that this offence could have resulted in a period of imprisonment.

Procurator fiscal depute David McDonald previously told Paisley Sheriff Court: “Just after midnight on March 13, Kyle McKendrick was at the ATM at the rear of the Day-Today in Clippens Road.

“McKendrick saw the accused running towards him and they engaged in a conversation.

“The witness asked Main where he was from and he replied Kilwinning.

“Main asked the witness what he was up to and he replied that he was lifting money when the accused then pulled out an empty Mad Dog 20/20 bottle from his jacket and stated ‘Give me your money then.’

“Holding the bottle in his right hand, Main struck McKendrick to the left side of his face, making the bottle smash.

“McKendrick was stunned and dazed from the impact.

“The accused then stated ‘I’ve got a blade and I’d kill c***s for less.’

“McKendrick tried to hold Main to prevent him hitting him further but both ended up on the ground in a struggle.”

The court heard McKendrick got to his feet and gave Main £70 in cash and he left the scene.

McKendrick returned to a friend’s house where he was taken to hospital and police were contacted.

Mr McDonald went on to explain how Main was causing drivers concern on the A737 as he walked towards traffic in the darkness.

He said: “Between 1.15am and 1.25am, police received three reports of a male walking on the A737 at the Johnstone/ Kilbarchan interchange and one report stated the male had said he had stabbed someone.

“Police attended and traced Main, whose hands were covered in blood.

“He was arrested and he told officers he had been at his girlfriend’s house. She was traced and she stated she hadn’t been in his company.

“Main freely told officers he had been at an 18th birthday party in Linwood and had drank a bottle of Mad Dog 20/20.”

He was taken to hospital for treatment to his hand when officers were made aware he matched the description of the male involved in an earlier assault in Linwood, and so his clothes were seized.

Mr McDonald added: “Around 3.30am in the Royal Alexandra Hospital, Main began to shout at officers ‘Your maw’s a f****t, your dad is a black b*****d.’

“The accused went on ‘I hate you f*****s, you gays, you blacks, you Polish c***s, see all the Polish c***s coming into the country do you think I’m gonna do a few days in the jail for that? I’m at the top, you’re at the bottom.’

“Main continued with offensive remarks and was informed of his arrest and placed in handcuffs when he stated ‘You’re lucky I’ve not spat on you, you p**f.

“Bet I don’t get remanded for this cause they are p***s in the justice system.

“I did do the stabbing but yous cant prove it, yous haven’t witnessed it, you need forensic evidence you f****t. The judge is a racist as well.’

“A doctor attended Main when he stated ‘Who are you, you P**i f*****s? I pay good my taxes.’

“Around 4.50am Main continued to shout and swear when he then stood up and spat at PC Cowan.

“He later stated to PC Cowan, ‘I’ll f*****g rape you, you wee p**f.’”

The court heard a £20 note was recovered from Main’s sock.

Mr McKendrick required seven stitches to the left side of his face which is expected to leave permanent scarring.

Defence agent David Nicholson told how Main is “extremely remorseful, ashamed and apologetic of his conduct.”

Mr Nicholson added: “He had consumed alcohol on this day and had used cocaine - for the first, and only time. He says this is not an excuse, but an explanation. He would like to apologise to the victim and say that he is extremely sorry.

“It is an issue that plays on his mind and will continue to do so. He regularly wonders how the victim is doing and the impact the scar has on his life.”

On sentencing, Sheriff Tom McCartney said: “The most significant factor in this matter is the very serious nature of the crimes.

“I read the narration of what occurred and the random violence and offensive nature of what was said is very disturbing.

“Normally, a lengthy detention would be inevitable. However, I’ve weighed up all the factors and after careful consideration, and with some hesitation, I can deal with this today.”

Sheriff McCartney placed Main, of Kirkland Crescent in Dalry, North Ayrshire, under supervision of the social work department for three years and ordered that he carries out 300 hours of unpaid work in the community.

A review hearing was set for July 22.
