The August bank holiday is fast approaching, and so too is the usual confusion around what employees are entitled to if they do - or don’t - work on Monday.
Jumping to the rescue with his easy breakdowns of Irish law was top Irish solicitor, Richard Grogan, who broke down exactly what your legal entitlements are from pay to annual leave.
Richard took to TikTok and Instagram to explain: “If you have worked 40 hours in the last four weeks, then you can get a paid day off on the bank holiday. If you haven’t done 40 hours, then no.

“If you are working on the bank holiday you can get either an extra days pay or an extra days holidays (annual leave) or a paid day off within the next four weeks."
“Even if you only work an hour or two on the bank holiday, you are still entitled to a full day’s pay or one of the other benefits like a day off."
Meanwhile, those who are on salary are still entitled to an extra day off, an additional day off, or additional days of paid leave.
According to Citizen’s Information, most employees are entitled to paid leave on public holidays.
There is an exception for certain part-time employees, but if you qualify for public holiday benefit, you are entitled to one of the following:
- A paid day off on the public holiday
- An additional day of annual leave
- An additional day's pay
- A paid day off within a month of the public holiday
You can ask your employer at least 21 days before a public holiday, which of the alternatives will apply. If your employer does not respond at least 14 days before the public holiday, you are entitled to take the actual public holiday as a paid day off.
