Do local sanctuary laws protect me?
Chicago and Illinois each have similar laws that prohibit local officials from helping federal immigration agents enforce immigration law. Both laws prevent local enforcement officers from asking for a person’s immigration status, detaining someone because of their immigration status or sharing information about immigrants with the federal government.
That means if you are an immigrant without legal status to be in the country, you won’t be stopped or detained by the Chicago Police Department just because of that status. And if you are arrested for some other reason, the law also bars the city or state from holding you for immigration enforcement, unless you face a federal criminal warrant.
Even with these rules against local cooperation, the federal government can enforce immigration law anywhere in the country, and city and state law enforcement officers can’t stop ICE agents from arresting noncitizens if the agents have a warrant signed by a judge ordering the arrest and deportation of an individual.
Meanwhile, President Donald Trump has taken aim at jurisdictions with sanctuary laws in an executive order that calls for withholding federal funding for any jurisdictions “which seek to interfere with the lawful exercise of Federal law enforcement operations.” A federal judge in Chicago blocked a similar attempt during the last Trump administration. — By Patrick Smith | WBEZ
