Trump's Trial Date in Jeopardy, Legal Woes Strengthening Him Politically

March 4th trial date in jeopardy due to appeals process.

In recent developments, the trial date of former President Donald Trump, slated for March 4th, appears to be in jeopardy as the appeals process could potentially extend the timeline significantly. The initial step in the appeals process involves Trump seeking a review of his claim of presidential immunity before a limited panel on the circuit court. Should this review not yield a favorable outcome, Trump can then escalate the appeal to the entire circuit court, known as an en banc review. Ultimately, if dissatisfied with the ruling, either Trump or Jack Smith, the plaintiff in the case, have the option to further appeal to the Supreme Court. However, the Supreme Court is not obligated to expedite the review process, as evident in recent cases.

The uncertain nature of the appeals process raises doubts about the possibility of the trial commencing before the upcoming election. According to Justice Department policy, it is preferred to avoid any appearance of intervening in an election when nearing the period preceding November. Jack Smith had previously requested an expedited review precisely due to these concerns. Consequently, the trial's chances of proceeding in March are now questionable.

Another recent development contributing to uncertainties regarding Trump's eligibility involves the Colorado Supreme Court's ruling, rendered on Tuesday. The court declared that former President Trump should not feature on the state's primary ballot. Trump's legal representatives have already stated their intention to appeal this decision to the Supreme Court. Former attorney general, Bill Barr, expressed disagreement with the ruling, deeming the legal argument supporting it as absurd and destructive. Barr further implied that such tactics employed by the left only serve to amplify support for Trump.

This latest ruling in Colorado adds to the mounting challenges faced by Trump's camp. Trump has long maintained that he is a victim of unfair targeting, often referring to investigations against him as witch hunts. The surge of frivolous investigations lacking substantial evidence has fueled Trump's narrative of persecution and strengthened his political position. Even skeptical voters, including independents, may begin to find validity in Trump's claims.

A coordinated effort backed by Democratic groups encompassing various states has also emerged. Lawsuits aiming to bar Trump from appearing on the ballot due to alleged violations of the 14th Amendment are being funded by Democratic dark money. The Colorado Supreme Court's interpretation of the events of January 6th as an insurrection under the 14th Amendment contributes to the potential dangers for Trump. Other states could potentially use this ruling as precedent to keep Trump off their respective ballots. To prevent a domino effect, legal experts advocate for swift action from the Supreme Court.

As the legal challenges against Trump multiply, it remains to be seen how these developments will impact his political future. The uncertainties surrounding the trial date, coupled with attempts to bar him from primary ballots, create a challenging landscape for the former president. Whether these efforts will ultimately strengthen or weaken Trump's position remains a critical question as the election draws near.
