Trump's Conviction Appeal Process Explained

Foreign President Trump is vowing to fight his conviction, with his attorneys outlining a plan for the appeals process. The sentencing is set for July 11th, just four days before the Republican National Convention commences in Milwaukee.

Right on Crime Executive Director, Brett Tolman, discussed the potential appeal strategies. One option is to file an emergency appeal with the Supreme Court to halt the sentencing while pursuing the appeal in New York courts. This approach aims to prevent Trump from facing jail time during the appeal process. The other route involves proceeding directly with the appeal in New York without Supreme Court intervention.

The looming sentencing date of July 11th raises concerns, especially given the judge's displeasure with Trump's alleged violations of the gag order. While the judge could consider home detention, the possibility of jail time for a nonviolent felony, despite the 34 counts, remains uncertain.

Tolman highlighted the uniqueness of the situation, suggesting that this judge might be more inclined to impose jail time compared to others, despite factors like Trump's lack of criminal history and low-level felony charges.

Speculation also surrounds the potential involvement of the US Supreme Court in the appeals process. Legal experts have discussed the slim possibility of the Court intervening, citing past instances where the Supreme Court paused proceedings in cases involving significant constitutional issues.

While the path for Supreme Court involvement may be narrow, historical precedents like Bush v. Gore and IBM demonstrate that such interventions are not unprecedented in the realm of criminal cases.
