Former President Donald Trump and seven co-defendants in the Georgia 2020 election subversion case are seeking an immediate appeal of a recent ruling that allowed Fulton County District Attorney Fani Willis to remain on the racketeering case. To appeal before trial, permission from Fulton County Superior Court Judge Scott McAfee is required. If granted, a three-judge panel of the 11th US Circuit Court of Appeals would decide on the matter.
Trump's lead attorney, Steve Sadow, emphasized the importance of determining whether Willis and her office can continue representing the State of Georgia in prosecuting the defendants. Sadow highlighted that McAfee's ruling acknowledged an 'appearance of impropriety' and an 'odor of mendacity' but did not dismiss the case or disqualify Willis.
McAfee's decision allowed Willis to prosecute Trump and his co-defendants but led to the resignation of her top prosecutor, Nathan Wade. The judge concluded that to dispel the 'cloud of impropriety' resulting from their romantic relationship, Wade had to step down if Willis remained in her role.
Wade, who confirmed that his romantic relationship with Willis has ended, resigned following the ruling issued on Friday.
