A legal battle initiated during the Biden administration paved the way for former President Donald Trump to remove several members from the Kennedy Center board. The case, Spicer v. Biden, involved former Trump press secretary Sean Spicer and others challenging President Biden's attempt to remove them from the Board of Visitors for the Naval Academy.
Spicer, who was appointed by Trump, refused to resign from his position despite receiving a termination ultimatum from the White House. With the support of America First Legal, founded by Stephen Miller, Spicer and others pursued a lawsuit against the Biden administration to establish the right of a president to dismiss certain appointees.
Although the lawsuit was ultimately dismissed by the district court, a similar case, Severino v. Biden, ruled that a president could remove appointees like Spicer at will. This legal battle highlighted the power struggle between the executive and judicial branches over the authority to appoint and dismiss federal officials.

John Malcolm from the Heritage Foundation noted that the case underscored the president's authority to appoint trustees aligned with his agenda, as seen in Trump's actions regarding the Kennedy Center board. The legal challenges faced by the Trump administration, including over 70 lawsuits, reflect ongoing debates about the extent of executive power.
Recent developments, such as the Supreme Court's intervention in reinstating a Biden appointee and the Justice Department's efforts to expand presidential control over agencies, illustrate the broader implications of these legal battles. The concept of a unitary executive, where the president holds ultimate authority over executive branch officials, has been a central theme in these disputes.
Reflecting on their legal strategy, Spicer emphasized the need for conservatives to assert themselves and push back against challenges to their agenda. He highlighted Trump's influence in encouraging conservatives to stand up for their beliefs and fight back against opposition, a sentiment that guided their approach to the lawsuit.
