A lawyer representing the family of a Nottingham man who died in Spain says that "no stone will be left unturned" as a second pathologist prepares to re-examine his body. Dad-of-two Tobias White-Sansom, 35, was taken to hospital on July 26 and placed in an induced coma after an incident at the Boomerang nightclub in Magaluf on the Spanish island of Majorca.
He is the brother of Nottinghamshire entrepreneur Maximillian White, who has made his wealth from medicinal cannabis and owns a property on the holiday island. Mr White-Sansom, who grew up in Radford, died five days later, prompting calls for an independent inquiry and his body to be returned to the UK.
Two months after the death a second post-mortem examination is due to take place to establish the cause of Tobias' death. Speaking on behalf of the family, his cousin Ricardo Capone said that doctor Javier Ladron de Guevara will conduct the second autopsy on Wednesday, September 21.
"Tobias' body was still not returned to the UK so we had to fly a pathologist from Madrid to Palma de Majorca to do an independent autopsy", Mr Capone added. "We still have not received the results of the first autopsy."
He added that he was "disgusted" by the delay, saying: "How is that acceptable? How do we not have the body yet after two months?"
Mr Capone listed the family's demands, which are: "First of all, we want answers. Two, we want his body." He added: "We want to attack the broader issue here. It is an issue that needs to be highlighted."
Lawyer Dan Morisson of Grosvner Law, in Mayfair, London, is in charge of leading the legal team "to investigate this and to bring all the proceedings that we want to bring". He added: "We are certainly seeking a UK inquest.
"There will be criminal proceedings, and there will also be compensation proceedings. Tobias had two children who now do not have a dad.
"There is certainly a combination of criminal and civil proceedings that we are seeking. Tobias was a young, healthy man. No stone will be left unturned."
A spokesperson for the Guardia Civil told Nottinghamshire Live that Tobias was expelled from the nightclub for "his aggressive behavior and refusal to wear a t-shirt". They added: "Guardia Civil responded to a notice from the establishment’s private security.
"This man assaulted the doorman of the nightclub for which Guardia Civil arrested him for a crime of injury. The agents had to reduce him due to his resistance and aggressiveness. He was taken to the hospital as an arrested person and the health services administered a painkiller."
In a previous statement, a spokesperson for The Foreign, Commonwealth and Development Office said: “We are supporting the family of a British man who has died in Mallorca and are in contact with the local authorities.”
