THREE Bandidos bikies who crashed a Christmas Day lunch in a backyard at Abermain and bashed a man in front of his extended family have successfully appealed against their jail terms in Newcastle District Court.
The usually quiet afternoon period on Christmas, 2018, was interrupted for one family and quickly descended into a chaotic scene as three bikies attempted to assault the man, while his loved ones tried to intervene to protect him, with the victim's grandmother even striking one of the Bandidos over the head with a bottle.
The main agitator Dylan Jack Hobbs was jailed for a maximum of 20 months, with a non-parole period of 12 months in Cessnock Local Court in June, while fellow Bandidos Warren Tredinnick and Mitchell Dunlop were each jailed for a maximum of 12 months, with a non-parole period of six months.
But after spending a night behind bars, Hobbs, Tredinnick and Dunlop were granted conditional bail in Newcastle Local Court after they each lodged an appeal against the severity of their sentence.
On Tuesday in Newcastle District Court, Judge Jennifer English said the sentences imposed in the local court were not too severe given the seriousness, but found each sentence could be served as an intensive corrections order in the community rather than behind bars.
The victim was at a family gathering at Abermain on Christmas Day, 2018, when he and Hobbs became involved in several arguments over the phone, culminating in the victim "inviting" Hobbs to attend the premises for a fight, according to a statement of police facts.
About two hours later Hobbs, Tredinnick and Dunlop walked through the unlocked front door of the home and found the man and his family on the back patio still celebrating Christmas.
Hobbs approached the victim, but the man's mother was between the pair, according to police facts.
Hobbs told the woman: "move the f--- away or I'll flog you too" before punching the victim in the face.
The victim punched him back, with his mother still between the pair trying to intervene and push Hobbs away.
Dunlop and Tredinnick pushed passed Hobbs and the woman and began assaulting the man down the side of the house.
Meanwhile, while Hobbs was tussling with the victim's mother, the victim's grandmother cracked him over the head with a bottle, according to police facts.
One of the Bandidos grabbed a shovel, but was disarmed by another man who had been trying to intervene to stop the assaults and told the bikies: "get the f--- out of my yard. Leave my premises now".
The melee spilled out the front of the home and the Bandidos jumped into a waiting car and left.
The victim suffered swelling and lacerations, while the rest of his family also suffered minor injuries.
