Texas Pipeline Company Sues Greenpeace Over Dakota Access Protests

A trial is underway in Mandan, North Dakota, where a Texas pipeline company is seeking potentially hundreds of millions of dollars from Greenpeace. The lawsuit, which includes allegations of trespass, nuisance, defamation, and other offenses, stems from protests against the Dakota Access oil pipeline in 2016 and 2017.

The pipeline, which crosses the Missouri River near the Standing Rock Sioux Tribe's reservation, has faced opposition from the tribe due to concerns about its impact on the water supply. Energy Transfer and its subsidiary Dakota Access claim that Greenpeace International and Greenpeace USA engaged in activities to delay the pipeline's construction, defame the companies involved, and coordinate protests involving trespassing, vandalism, and violence.

Greenpeace has denied these allegations and views the lawsuit as an attempt to silence critics of the oil industry. The organization argues that the case is a test of free speech and protest rights, emphasizing the importance of bringing visibility to such legal battles.

Energy Transfer, on the other hand, asserts that the lawsuit is about holding Greenpeace accountable for not following the law rather than restricting free speech. The company's spokesperson stated that while they support lawful protests and freedom of expression, they believe that legal action is necessary when activities are not conducted in accordance with the law.

This legal battle is not the first between the two parties. Energy Transfer previously filed a similar case in federal court in 2017, which was dismissed in 2019. The current lawsuit, now being heard in state court, seeks damages in an amount to be determined during the trial.

As the trial progresses, both sides are presenting their arguments, with Greenpeace emphasizing the importance of protecting free speech and Energy Transfer focusing on the alleged unlawful actions of the environmental organization. The outcome of this trial could have significant implications for future protests and legal battles involving environmental activism and corporate interests.
