Suspended jail terms for pair involved in home invasion

Soon after waking up, a 13-year-old girl saw people with Halloween masks and weapons in her house.

Moments later she heard a gun shot and her father Michael Menzel screaming.

The 48-year-old was pronounced dead about an hour later.

Phoenix Nugent and Matthew David Taylor were among five people involved in the violent home invasion south of Brisbane in October 2019.

But they will be released from custody after receiving suspended prison terms in Brisbane Supreme Court on Monday.

Days before the attack, a co-offender had a confrontation with Mr Menzel over a drug debt and was "made to feel a goose", crown prosecutor David Nardone said.

As a result, the co-offender allegedly hatched a plan to go to Mr Menzel's Gleneagle house and "take all of his stuff".

It involved buying masks and costumes as well as equipment to restrain people including cable ties.

A vehicle and registration plates were stolen so they could be used in the attack.

On the drive to Mr Menzel's house, the co-offender allegedly gave directions to the four others - including Taylor and Nugent - and ordered them to put on "menacing" Halloween masks.

The co-offender had a sawn off shotgun while others were armed with a bat, a hammer and a machete, the court heard.

After Taylor was allowed to wait in the vehicle, the co-offender kicked in Mr Menzel's front door and the others followed.

The 13-year-old girl was woken by the noise before Nugent - wearing a "white skull mask" - entered her bedroom, taking her phone and tablet.

A 40-year-old housemate was struck in the head with the hammer.

The girl then heard gun fire and her father scream before the four intruders fled.

She found Mr Menzel in a puddle of blood.

He was treated at the scene for about an hour by paramedics but died just after 7am.

The official cause of death was a shot gun wound to the left thigh.

The girl said in her victim impact statement she had night terrors and suffered flashbacks, sometimes triggered by a car backfiring or a door slamming.

She felt it was now much more difficult to achieve not only her dreams but even simple tasks such as getting her year 12 photos because she doesn't have a parent to sign a consent form.

Taylor later burnt the vehicle before travelling to NSW but handed himself in to police within a week.

Nugent initially denied her involvement when located by police but the next day told officers she was just doing what she was told because she was affected by drugs.

Taylor, 32, and Nugent, 27, pleaded not guilty to murder but guilty to manslaughter along with a number of other charges.

They each received five years in prison, suspended for five years, from Justice Thomas Bradley.

Nugent was also given three years' probation.

Both had spent about three-and-a-half years in pre-sentence custody.
