Principal Deputy Solicitor General Brian Fletcher, a seasoned Supreme Court advocate, will be making these arguments. Fletcher, who has experience both in and out of government, will challenge the appeals court's decision to subject the law to the lowest level of judicial review.
The administration's stance differs from that of the law's challengers, as it does not take a position on whether the law in question meets strict scrutiny standards. Instead, the Biden administration is advocating for the case to be sent back to a trial court for further review rather than an outright dismissal.
Prior to his role in the Biden administration, Fletcher was a professor at Stanford Law School and had served in the Obama White House. He also has experience working in private practice in Washington, DC.
