Supreme Court To Determine Standard Of Review For Texas Law

At the Supreme Court, a pivotal case is unfolding with a focus on a technical legal question regarding the Texas law. The central issue revolves around determining the standard of judicial review that should be applied to examine the law.

Initially, a federal judge in Texas blocked the law by applying strict scrutiny, the highest level of judicial review that demands government restrictions on speech to be supported by a compelling government interest and tailored to further that interest. However, a divided appeals court panel in New Orleans overturned this decision, opting for the rational-basis test, which only requires a legitimate state interest in government regulation of speech.

Once the Supreme Court determines the appropriate level of review for this case, it may choose to either remand the case to a trial court for application of the standard to the facts or directly apply the standard itself to expedite the litigation process.
