Supreme Court Stays Silent on Gun Control Laws in Delaware and Maryland

The U.S. Supreme Court declined to hear appeals from Second Amendment activists challenging gun control laws in Delaware and Maryland. The Supreme Court's refusal to hear the appeals involved two significant pieces of legislation: Delaware's ban on assault-style rifles and large-capacity ammunition magazines, as well as Maryland's stringent handgun licensing requirements. These laws were enacted in response to the tragic Sandy Hook Elementary School shooting in 2012, which claimed the lives of 26 individuals, including 20 children.

Delaware's law prohibits the sale, transfer, and possession of certain semi-automatic firearms deemed assault weapons. Additionally, it restricts magazines that hold more than 17 rounds. Similarly, Maryland's handgun licensing law requires individuals to undergo a thorough background check and demonstrate a good reason for needing a handgun before obtaining a permit.

Supreme Court's Approach to Gun Rights

The Supreme Court’s decision not to engage with these challenges is actually fairly consistent with its recent history regarding gun rights. Since the landmark 2008 case District of Columbia v. Heller, which affirmed an individual's right to possess firearms for self-defense within the home, the Court has been notably reticent about taking on cases that could further define or expand Second Amendment protections.

Since 2010, the Supreme Court has declined to hear numerous cases related to state gun laws. This pattern suggests a strategic choice by the justices to avoid contentious issues surrounding gun control amid a politically charged environment. The lack of commentary accompanying their decision also reflects the Court’s preference for maintaining judicial restraint on this divisive topic.

For advocates of stricter gun control measures, this decision is a minor victory that reinforces their ability to implement regulations aimed at reducing gun violence.
