A South Carolina woman has filed a lawsuit against Walmart after she allegedly caught one of its delivery drivers masturbating in her driveway.
The incident unfolded on July 8, 2024, at a woman's home in Horry County, South Carolina, Count On 2 News reported.
Alvin B. Ortiz, 39, a driver for Walmart's Spark Delivery service, was delivering a grocery order to the woman's home. After completing the delivery around 9:10 a.m., Ortiz remained in his vehicle in her driveway for 10 to 15 minutes.
When the woman went outside to investigate, she allegedly found Ortiz with his pants down, engaging in inappropriate behavior. In response, she fled inside, grabbed her child for safety and called a neighbor.
The neighbor confronted Ortiz, but the situation escalated into a verbal altercation, with him threatening to return and "f*** everyone up" before fleeing the scene.
The woman contacted police, and Ortiz was arrested the following day. He was charged with indecent exposure and released on bond shortly afterward.
On Dec. 19, the woman filed a legal complaint against Walmart, Spark Delivery and Ortiz. The suit alleges that Walmart failed to properly vet Ortiz before hiring him as a delivery driver.
The woman is seeking damages for both past and future medical expenses, along with compensation for her mental and emotional suffering.
Walmart and Spark Delivery have yet to comment publicly on the lawsuit.
