A jury's guilty verdict in the case of a man accused of murdering a father-of-five who was on his way to celebrate Father's Day has been set aside.
Alex Robert Smart will face a retrial after taking his case to the Queensland Court of Appeal.
Tylor Bell was stabbed in front of his father at a red traffic light after going to a shopping centre in Gympie, north of Brisbane, on September 1, 2019.
Despite his injuries the 31-year-old was able to drive to a nearby hospital, but he died a week later.
The father and son had gone to buy groceries as Mr Bell's five children were visiting for Father's Day.
Smart was found guilty and sentenced to life behind bars in May last year after a jury trial.
The Appeal Court on Friday set aside the jury's verdict and ordered a retrial, with reasons for the decision to be published later.
