Restaurant worker left pedestrian with broken jaw after collision while moving boss's car in Newcastle city centre

A restaurant worker left a pedestrian with a broken jaw after he ploughed into him while moving his boss's car.

Marius Barbu had no insurance and had never passed a test when he struck the male on Bath Lane, in Newcastle City Centre, one afternoon in February this year. A court was told that the 23-year-old stayed with the victim, whose face had struck the road after he rolled off the bonnet of the car, while paramedics and police arrived.

The man was taken to hospital where he needed treatment for multiple fractures of the jaw.

Barbu, of Leazes Park Road, in Newcastle City Centre, has now been banned from getting behind the wheel for 12 months after he pleaded guilty to careless driving, driving without insurance and driving otherwise than in accordance with a licence.

Sue Baker, prosecuting at Newcastle Magistrates' Court, said the accident happened on February 2 this year when Barbu was behind the wheel of a Toyota Avensis and was travelling down Bath Lane. Mrs Baker continued: "The victim was crossing the road and the defendant failed to notice him in his path while turning at a junction.

"He struck [the victim]. He suffered facial injuries. He received treatment for multiple fractures of the jaw."

The court heard that Barbu, who has no previous convictions, was not insured to drive the vehicle as it belonged to his boss and had never held a full driving licence. Mark Styles, defending, said Barbu was working at a restaurant in Stowell Street at the time when his manager asked him to move his car as the parking ticket was coming to an end.

Mr Styles added: "He stupidly agreed to do so. He then just doesn't see [the victim] in the road at the time. [The victim] hits his the bonnet of the car and can't put his hands out in time to stop himself, which causes his face to hit the ground first."

The court was told a witness phoned an ambulance while Barbu waited at the scene for the police to arrive.

Fining him a total of £300 and ordering him to pay £85 costs and a £95 victim surcharge, District Judge Paul Currer said: "It's a serious offence because you're involved in an accident by careless driving. You have never passed your test and you were not insured. However, I bear in mind you level of co-operation with police at the scene."
