Two Republican lawmakers have introduced a new bill called the AMERICANS Act aimed at providing relief to service members who were discharged due to the military's COVID-19 vaccine mandate. The legislation, put forth by Sen. Ted Cruz of Texas and Rep. Pat Harrigan of North Carolina, seeks to offer reinstatement and back pay to those affected by the mandate.
The AMERICANS Act prohibits the Pentagon from implementing any further COVID-19 vaccine mandates without congressional approval. It specifically addresses the cases of service members who were fired solely for refusing the COVID vaccine, ensuring they have the opportunity to return to their positions and receive compensation for any lost time.
In addition to reinstatement, the bill also addresses the issue of demotions that occurred as a result of the vaccine mandate. It proposes restoring the rank of individuals who were demoted, along with providing them back pay and benefits to make up for any financial losses incurred.
For service members who opt not to rejoin the military, the legislation includes provisions to restore their discharge status to 'honorable,' thereby reinstating their GI Bill and health care benefits.
The COVID-19 vaccine mandate, initially announced by Defense Secretary Lloyd Austin in August 2021, was rescinded in January 2023 following congressional directives. During the period when the mandate was in effect, over 8,400 troops were separated, while many others sought exemptions based on religious or medical grounds.
Sen. Cruz emphasized that the AMERICANS Act aims to rectify the consequences faced by service members due to the vaccine mandate, asserting that it is the right course of action. Rep. Harrigan echoed similar sentiments, highlighting the sacrifices made by military personnel and expressing a commitment to upholding their honor.
The legislation aligns with promises made by President-elect Donald Trump's nominee for Defense secretary, Pete Hegseth, who pledged to reinstate and compensate those who were discharged due to the vaccine mandate. Former President Trump also indicated his intention to rehire all individuals who lost their military positions as a result of the mandate.
While Pentagon leaders had considered offering back pay to affected troops following the rescindment of the vaccine mandate, the initiative did not materialize. Republicans have consistently criticized the mandate, citing its negative impact on morale and recruitment efforts within the military.
