Raging dad grabs partner by neck and hair when she comes home "drunk" after celebrating mum's birthday

A father-of-two assaulted his partner when she came home "drunk" after celebrating her mother’s birthday.

Paul Hart, 34, grabbed his partner of seven years by the throat and by the hair on January 30 this year at her property in Paisley.

Paisley Sheriff Court heard how Hart and Ms Roach have been in a relationship for seven years, have two children together and don’t live together.

The procurator fiscal depute explained: “Around 6pm on Saturday, January 29, Ms Roach attended at her mum’s house with a friend to celebrate her mother’s birthday.

“The accused remained within Ms Roach’s home with two children.

“Shortly after midnight, Ms Roach contacted Hart asking to pick her up and bring her home.

“Ms Roach and a friend returned home shortly after and both went upstairs with a glass of wine.

“The children were within the bedroom asleep at this time.

“Around 2.30am Ms Roach’s friend was on the phone when Ms Roach heard the accused storming up the stairs.

“He entered the bedroom looking angry and Ms Roach asked him to leave the room and leave her alone.

“The accused then reached out his hands, and grabbed Ms Roach by the throat before grabbing her by the hair.

“Ms Roach shouted at him to stop and the friend also observed this and shouted at him to stop assaulting Ms Roach.

“Police were contacted and the accused made off.

“Officers attended around 2.40am and observed Ms Roach to be extremely upset and crying.

“The accused was traced later that day at his home address and was arrested at 10.35 on Sunday, January 30.

“When cautioned and charged, Hart replied, ‘her and her pal were steaming and aye I grabbed her by the hair.’”

Defence agent Terry Gallanagh told the court Hart was “ashamed of his conduct.”

He explained: “When Ms Roach came home with her friend, they were drunk and noisy. He asked them to calm matters down and be quiet so not to disturb the children. An argument ensued and Mr Hart temporarily lost control of himself and raised his hands to which he is horrified.

“This was entirely out with his character and he has an expectation the relationship will continue.”

On sentencing, Sheriff Brian Mohan said: “You lost control and you assaulted your partner, but I am willing to let you show this was a one off and defer sentence on this matter for good behaviour.”

Sheriff Mohan granted Hart bail, with a “cooling-off period” preventing him from accessing Roach's home address for fourteen days.

Hart of Luath Street in Govan will return for sentencing in six months time when a good behaviour report will be made available.
