The conduct of police who arrested a political satirist accused of stalking former NSW deputy premier John Barilaro, could be investigated by the state's police watchdog.
Attorney General Mark Speakman told a budget estimates hearing on Wednesday he believed the arrest of friendlyjordies producer Kristo Langker is likely to be referred to the Law Enforcement Conduct Commission.
Last week police dropped all charges against Mr Langker after he was accused of stalking the now retired MP.
Mr Speakman said he had no involvement in the matter.
"I don't think I should be commenting on matters where I'm not across the detail," Mr Speakman said.
"I certainly understand the criticism of the police action in that matter.
"I've seen suggestions on social media the matter may be referred to the law enforcement conduct commission," he said.
"While there's a live prospect of the matter going to the law enforcement conduct commission, as an executive, giving any commentary on whether the LECC should or shouldn't uphold a complaint - I think that runs the risk of an improper signal to an independent body that oversights the police."
Labor's Adam Searle asked whether there was a perception police had been "deployed" to arrest Mr Langker after his boss, YouTuber Jordan Shanks of friendlyjordies was sued for defamation by Mr Barilaro.
Mr Speakman said he understood the criticism but could not endorse it.
He said he believed the matter would be referred to the police watchdog in the near future, and if not he would consider if there was merit in referring it himself.
