Paisley woman caught drink driving told cops 'I've only had prosecco and spirits'

A secondary school teacher who was caught drink-driving told cops she had only drank “prosecco and spirts.”

Rosin Miller of Friarshall Gate, Paisley had been drinking with her boyfriend last month when an argument broke out which resulted in Miller – who was three times the legal limit, getting behind the wheel of her car to “calm down.”

Miller, 28, who is employed as a secondary school teacher by Glasgow City Council, was arrested after her boyfriend called the police to report she was drink driving.

Procurator fiscal depute Ms McLeod told Paisley Sheriff Court: “Around 1am on Sunday, February 13, police attended at Friarshall Gate after receiving a report of a driver under the influence.

“Officers observed the accused in the driver’s seat and no one else in the car.

“Police activated their blue lights and Miller stopped her vehicle and immediately opened the door and stated, ‘I am sorry, I have only had a couple of drinks.’

“Police removed he keys from the ignition and the accused stated, ‘Aye I’ve been drinking but I’ve only had prosecco and spirits.’

“A roadside breath test was carried out which Miller failed.

“She was arrested and taken to Govan police station where she provided a further two samples of breath with the lowest reading being 70mg of alcohol in 100ml of breath.

“She was cautioned and charged and made no reply.”

Miller, admitted she drove her Citroen C4 Cactus on February 13 in Paisley with 70mg of alcohol in 100ml of breath. The legal limit is 22mg.

Defence agent Mr Buchannan told the court the teacher was “extremely upset” by the matter and explained: “Ms Miller accepted responsibility straight away.

“She and her partner had taken drink and an argument between them began.

“She left to calm down and in the heat of the moment made a foolish error of judgement and got in the car to drive to a car park.

“It was a short distance and she returned back home.

“Her boyfriend was concerned for her welfare and he contacted the police.

“She has intimated this to her employers who are supportive of her and have referred her to a support scheme and she imagines she will be referred to the General Teaching Council.

“She has realised the foolishness of her actions.”

On sentencing, Sheriff Tom McCartney fined Miller £640 reduced from £900 for her early plea and ordered her to pay this at £100 per month.

Miller was also banned from driving for 14 months and if she completes the drink drive rehabilitation programme a further three months will be reduced from her ban.
