Ohio law mandates a deadline of August 7 for certifying a presidential candidate, while the Democratic National Convention, where nominees are officially selected, commences on August 19 this year.
In a letter to Ohio Democratic Party Chairwoman Liz Walters, Paul Disantis, chief legal counsel for the Ohio secretary of state, presented potential solutions to ensure Biden's inclusion on the ballot.
Disantis suggested that either the Democratic National Committee adjust the timing of its nominating convention or the Ohio General Assembly enact an exception to the statutory requirement by May 9, 2024.
Ohio Democratic Party Communications Director Matt Keyes stated that they are currently investigating the situation, while a spokesperson for the Biden campaign expressed confidence in Biden's presence on the ballot in all 50 states.
