Nevada Man Charged With Hate Crime After Verbal Altercation

A Nevada man, Gary Miller, along with his wife and daughter, were arrested on various misdemeanors following a verbal altercation with a Black man, Ricky Johnson, in Virginia City. The incident occurred during a classic car show and escalated when Miller referenced a 'hanging tree' to Johnson. The encounter turned heated, with both parties exchanging profanities.

Miller admitted to mentioning the 'hanging tree' to Johnson, which led to their arrests. The incident, which took place on August 2, drew swift condemnation from local and state officials. Nevada Attorney General Aaron Ford praised the arrests, emphasizing the need to hold individuals accountable for racist actions.

Miller faces charges of noise violation and breach of peace, with the latter carrying an enhancement due to the alleged racial motivation behind his actions. His wife, Janis Miller, is charged with battery, while their daughter, Tiffany Miller, faces a count of obstructing or delaying a police officer.

Johnson, who was gathering signatures for a proposed ballot measure, recorded the altercation after Miller's initial comment. The situation escalated further when Miller reportedly called Johnson a racial slur. Miller claimed that Johnson became agitated when he mentioned supporting Trump and made the 'hanging tree' remark in response.

The sheriff's office is investigating vandalism at a local business and threats made to businesses and owners following the incident. Miller accused Johnson of attempting to escalate the situation and making threatening calls to him and his wife.

The Millers declined a public defender and it remains unclear if they have legal representation. The charges against them carry a maximum penalty of six months in jail if convicted. Johnson, who resides outside Houston, has not responded to requests for additional comments.
