Man jailed after turning up at ex-partner's Barrhead house in breach of court order

A man who turned up at his former partner’s home when he had been ordered by a court not to go near her has been jailed for eight months.

Stuart Melvin, 45, was made subject of a non-harassment order in December last year that prevented him from contacting or approaching his ex-partner Joanne Burns.

But on April 29, Melvin appeared at her home address in Barrhead – breaching the conditions of his order.

Melvin, who appeared at Paisley Sheriff Court via video-link from HMP Low Moss, admitted his guilt.

Procurator fiscal depute Dana Barclay told the court the non-harassment order was imposed at the town’s court on December 10 last year.

She explained: “Conditions of the order where that the accused doesn’t contact or approach Joanne Burns or attend at her property.

“On Friday, April 29, around 11pm, the accused attended at Ms Burn’s property in Manse Court while under the influence of some sort of substance and she contacted the police.

“Police attended and met Ms Burns in the common close and she advised the accused had attended her house.

“He was traced nearby and checks confirmed he was subject to the non-harassment order.

“He was arrested, cautioned and charged and replied, ‘I wasn’t in the flat.’

“He was taken to Govan police station and held in custody.”

Defence solicitor Jim Clarke told the court Melvin still has feelings for Ms Burns.

Mr Clarke added: “He accepts the court may make another non-harassment order.

“He has feelings for her but he is now in a position to move on from this relationship.

“He is realistic about his prospects and that the court will have custody in its mind.”

Sentencing, Sheriff Brian Mohan said: “You’ve got a terrible record and a record with a number of domestic incidents but I am able to deal with this today given your plea.”

Sheriff Mohan jailed Melvin for 12 months reducing this to eight months to reflect his plea..

In addition, Sheriff Mohan imposed a non-harassment order for two years preventing him from contacting Ms Burns.
