Man in court for dangerous driving causing death of son

A man accused of dangerous driving that caused the death of his son has been ordered to stand trial.

Phillip Andrew Bale's case was committed to the district court following a Brisbane Magistrates Court hearing on Monday.

The 11-year-old boy died the day after a red Holden Commodore crashed into traffic lights at Wakerley, in southeast Brisbane, in September last year.

The court was told the vehicle had done an illegal U-turn and run a red light before the crash.

Witnesses also told of the Commodore speeding and spray coming off the back tyres but agreed it was their opinion the vehicle was going faster than the speed limit in wet conditions.

After hearing from four witnesses, including a crash investigator, defence barrister Simon Lewis argued there was no case against Bale, saying observations made by police were consistent with the vehicle aquaplaning.

After Magistrate Mark Nolan said the evidence of witnesses regarding Bale's speed was one factor, Mr Lewis instead agreed to the charge being committed to the higher court.

Defence would make submissions about the case to the office of the Director of Public Prosecutions, Mr Lewis said.

Bale was committed to stand trial on one charge each of dangerous operation of a vehicle causing the death of Jasper Bale and driving with a relevant drug present in his blood.

His bail was continued, with the case due to be mentioned in the Brisbane District Court on March 8.
