Man claimed police attacked him with baton during disturbance at Lanarkshire home

A man arrested following a disturbance at his Hamilton home claimed he struggled with police officers because he was being hit with a baton.

Hamilton Sheriff Court heard that four officers tried to subdue Stephen Parkin during the incident in Mennock Court.

One who gave evidence during his trial said he was so aggressive that she feared she and her colleagues might be killed.

Parkin was convicted of threatening or abusive behaviour at his home on October 8.

the 46-year-old was also found guilty of resisting arrest and shoving an officer to the floor before trying repeatedly to punch him.

However, Parkin was cleared of assaulting three other officers.

The court heard police were called out to deal with a domestic issue involving verbal abuse and furniture being smashed up.

Giving evidence, one officer said: "He was fighting with all four of us. I feared for my life and my colleagues' lives."

Questioned by defence agent Jackson Bateman, the officer accepted that Parkin had bruises after the incident and these were caused by blows from a police baton.

Mr Bateman stated: "He was shouting 'Calm down. What is wrong with you?' He accepts resisting as he was being struck by the baton."

The officer said she couldn't recall Parkin making those comments. She insisted that hitting him with the baton was "justified".

After the verdicts, Sheriff Louise Gallacher adjourned the case for a criminal justice social work report and an electronic tagging assessment.

Parkin will be sentenced next month.
