Man charged after hero mum loses her leg in horror crash near Aldi

A driver has been charged in connection with a horror crash in Wirral that caused a heroic mum to lose her leg.

Ruby Flanagan from Wallasey, was at Bidston Moss Retail Park with her nan on Monday, August 16, 2021, when she and her five-month-old child were involved in a crash. She was walking near Aldi when she was crushed between a silver Mercedes and a blue Volkswagen.

Her sister-in-law Chelsea later said she managed to throw her child clear when she realised she was about to be hit. Ruby, a nurse in Arrowe Park Hospital, was airlifted to Aintree Hospital after the crash and had to have her right leg amputated and the other put into a stabilising cage.

She has since had a number of operations after suffering a shattered pelvis, broken leg and a cracked spine. Now, 83-year-old Eric James, from Oxton, has been charged with causing serious injury by dangerous driving.

He had originally been charged with careless driving but the more serious charge was laid by prosecutors this morning at Liverpool Magistrates’ Court. James was not in court today to enter a plea. John Weate, defending, said James, of Victoria Mount, now suffers from Lewy Body disease and is effectively housebound.

Magistrates approved Mr Weate’s request for an eight week adjournment to allow doctors to assess whether James will be able to enter a plea or face a trial. He will go before magistrates again in July.
