Lanarkshire teen plunged from first floor window after assault by girls, one aged just 12

A teenager was badly hurt when she plunged from a first floor window after being assaulted by two other girls, one aged just 12.

The 17-year-old victim suffered fractures to her pelvis and wrist when she hit the ground.

The incident happened in Glencleland Road, Craigneuk, on April 19 last year.

The younger girl, now 13, and her 16-year-old co-accused were cleared by a jury this week of shoving the victim out of the window to her severe injury and danger of life.

But they were convicted of assaulting the teenager before she fell and robbing her of her phone.

The verdict followed a four-day trial at Hamilton Sheriff Court.

The victim said she was a resident in a care home and travelled to meet her 12-year-old friend, whom she believed to be aged 16.

They were joined by the other girl and spent the evening drinking in a flat.

She told the court the two accused became angry because she had been reported missing from her care home and they didn’t want the police turning up at the flat.

She claimed she was punched repeatedly and tried to flee, but the door was locked and she was attacked again when she went to the bathroom.

The witness told Alice Carey, prosecuting: “One of them grabbed my hair and the other kicked me.

“I was shoved over to the window. I was face down and my head and chest were hanging out of the window.

“I was really scared and asked them to stop, but they shoved me out of the window.

“Then I was lying on the ground, shouting for help. I tried to get up and couldn’t. I think I passed out.”

The teenager said that, on a scale of one to 10, the pain level was 10.

She spent more than three weeks in hospital, undergoing operations on her wrist and pelvis, and still receives physiotherapy.

She said: “I’m on a waiting list for reconstructive surgery to my pelvis.

“The pain has been getting a lot worse in the past few months and I struggle to walk a distance.”

It was suggested that she had jumped out of the window, but the teenager replied: “No. I was shoved.”

Neither accused gave evidence but the court heard that when police officers quizzed her the 12-year-old stated: “I never flung her out the window.”

Both accused admitted acting in a threatening or abusive manner on a train travelling between Motherwell and Wishaw on the same day.

The 13-year-old further admitted assaulting three fellow passengers and pulling an emergency lever, preventing the train from leaving a station.

Sheriff Martin Jones deferred sentence on both girls, who are too young to be named, until next month for background reports and the advice of the children’s hearing.

Bail was continued for both.
