Justice Department Files Lawsuit Against Norfolk Southern For Train Delays

The Justice Department has taken legal action against Norfolk Southern, accusing the rail company of causing significant delays for Amtrak passengers traveling between New York and New Orleans. The civil lawsuit alleges that Norfolk Southern has repeatedly failed to give priority to Amtrak passenger trains over its freight trains, as required by federal law.

Attorney General Merrick Garland emphasized that Americans should not face travel disruptions due to rail carriers violating the law. The complaint filed in a federal court in Washington, DC, cited instances where Amtrak trains were forced to wait behind slow-moving freight trains, resulting in substantial delays for passengers.

Norfolk Southern has stated its commitment to working with Amtrak and states to improve passenger service and ensure compliance with regulations. The company expressed its intention to address concerns regarding on-time performance and collaborate with Amtrak to enhance service along the Crescent Route.

Norfolk Southern Faces Scrutiny Over East Palestine Derailment

In a separate incident, Norfolk Southern recently reached a $310 million settlement with the Environmental Protection Agency and the Justice Department over a train derailment in East Palestine, Ohio. The derailment, which occurred in February 2023, led to the release of hazardous chemicals into the environment, causing significant damage to the community.

Following the derailment, concerns were raised about the safety of residents in East Palestine, with reports of health issues such as rashes, nausea, and respiratory problems. Despite initial assurances of safe air quality and water, residents continued to experience health challenges in the aftermath of the incident.

The National Transportation Safety Board conducted a hearing to investigate the derailment, focusing on Norfolk Southern's decision to conduct a controlled burn of tank cars carrying toxic chemicals. While the railroad defended the burn as a necessary safety measure, NTSB officials questioned the rationale behind the procedure.

The legal actions against Norfolk Southern underscore the importance of ensuring compliance with regulations and prioritizing the safety and well-being of passengers and communities affected by rail incidents.
