Judge To Re-Read Jury Instructions For Deliberating Jury

Jury deliberates in trial of paramedics involved in death of Elijah McClain

Judge Juan Merchan has announced that he will be re-reading pages six to 35 of the jury instructions in response to a request from the jury. This decision comes after it was revealed that the jury did not have a written copy of Merchan's charging instructions when they began deliberating the previous day. Unlike most federal judges who typically provide the actual document to the jury during deliberations, New York state courts have a prohibition against this practice.

During the court proceedings, Merchan informed the court that the jury specifically requested a re-reading of the judge's instructions, starting with how they should consider facts and the inferences that can be drawn from them. Notably, the judge used a metaphor involving rain to illustrate a point in the instructions. Additionally, the jury has asked to hear the instructions related to the charges for count one.

This development underscores the importance of clarity and understanding in legal proceedings, especially in complex cases where the jury's comprehension of the instructions is crucial to reaching a fair and just verdict. Merchan's decision to accommodate the jury's request for a re-reading of the instructions demonstrates a commitment to ensuring that the jury has all the necessary information to make an informed decision.
