Judge Dismisses Capitol Riot Case, Emphasizes Truth Of Events

A senior judge on the federal court in DC dismissed one of several US Capitol riot cases on Wednesday. However, she made it clear that President Donald Trump's clemency for January 6 defendants will not alter the truth of what occurred that day. Judge Colleen Kollar-Kotelly emphasized the importance of documenting the violence 'for posterity.'

This order marks the first statement from the DC District Court to challenge the pardons and the attempts to dismiss Capitol riot cases. Kollar-Kotelly stated that the truth of the events on January 6, 2021, is preserved through thousands of videos, trial transcripts, jury verdicts, and judicial opinions.

The judge highlighted the heroism of law enforcement officers who responded to the violence, noting their bravery in protecting the Capitol and congressional members despite facing a violent mob armed with bear spray. She acknowledged the injuries sustained by officers from five different police forces.

While the presidential clemency led to the release of convicted January 6 rioters from federal prisons, it does not have the authority to dismiss cases where alleged rioters are awaiting trial or sentencing. Kollar-Kotelly mentioned that a federal court can require DOJ prosecutors to provide reasons and facts before dismissing a case.

Although some judges overseeing the rioters' cases may delay final decisions in light of Trump's actions, the truth of the events and the role of law enforcement on January 6 remain unchanged. The judge's statement underscores the significance of upholding justice and accountability in the face of attempts to downplay the severity of the Capitol riot.
