Judge Denies Request To Instruct Jury On Hush Money Legality

Former President Donald Trump's Hush Money Trial Continues In New York

A recent court proceeding saw defense attorney Emil Bove arguing for a jury instruction regarding the legality of hush money. Bove contended that hush money is not illegal and wanted the judge to convey this to the jury.

Prosecutor Joshua Steinglass opposed Bove's request, stating that it was essentially asking the judge to make legal arguments on behalf of the defense. The debate between the two legal representatives unfolded in front of Judge Juan Merchan.

Ultimately, Judge Merchan decided not to include the requested instruction in the jury's guidance. He pointed out that the concept of hush money not being illegal had already been established through testimony presented in court. Merchan expressed his belief that the defense would likely raise this argument during their summations, and the prosecution would not contest it.

Merchan emphasized that providing a specific instruction on the legality of hush money would be excessive. He stated, 'I think that to take it to the next level and actually give an instruction to the bench is taking it too far. I don’t think it’s necessary.'

The courtroom exchange highlighted the strategic legal maneuvering and differing perspectives between the defense and prosecution regarding the handling of the hush money issue in the case. While Bove sought a formal instruction to the jury, Merchan's decision reflected a cautious approach to avoid potential overemphasis on a point that had already been addressed in the trial proceedings.
