The Manhattan district attorney's office filed a motion accusing Trump of violating the gag order by posting on social media about his former lawyer Michael Cohen and the jury in his case.
Prosecutors are seeking a $1,000 fine per violation and a warning that further breaches could result in additional fines or even a 30-day incarceration. They emphasized the importance of reminding Trump that, as a criminal defendant, he is subject to court supervision.
Despite the gag order, Trump has engaged in a public feud with Cohen, a key witness in the case. Cohen, who served time in federal prison for campaign finance violations related to a payment to Stormy Daniels, responded to Trump's remarks on Twitter.
Trump's legal team contends that his social media posts do not contravene the gag order, arguing that Cohen's attacks on Trump are campaign-related and thus warrant a response. They accused Cohen of being fixated on undermining Trump for personal gain.
Prosecutors highlighted several of Trump's posts on Truth Social, including references to Cohen and the jury. The court proceedings are ongoing, with the jury scheduled to reconvene for the trial's second day.
As the hearing continues, the court has extended its session due to the Passover holiday, with proceedings set to conclude at 2 p.m. ET on Tuesday.
