Hunter Biden's Legal Team Withdraws Motion For New Trial

Hunter Biden

Hunter Biden's legal team filed and quickly withdrew a motion for a new trial on Monday, nearly a week after he was found guilty on all charges related to his purchase of a firearm in 2018.

Biden's legal team, led by attorney Abbe Lowell, filed a motion in Delaware federal court on Monday morning requesting a new trial, arguing the court lacked jurisdiction as two appeals in the case are still pending.

The motion argued lack of jurisdiction due to pending appeals in the case.

The court did not proceed with the trial as the Third Circuit appeals court had not issued its mandate.

The motion was based on the argument that the court did not have jurisdiction to proceed with the trial as the Third Circuit appeals court had not issued its mandate on the pending appeals.

However, the motion was swiftly withdrawn from the court document website following its filing.

Biden was convicted of making false statements in the gun purchase, including lying on a federal firearm form about his substance use history. The prosecution presented evidence of Biden's documented history of drug abuse, including details from his memoir 'Beautiful Things.'

During the trial, Biden's defense did not dispute his substance abuse history but argued that he did not consider himself an active drug addict at the time of the gun purchase, pointing to his rehab stint prior to the purchase.

The jury deliberated for about three hours over two days before finding Biden guilty on all charges. He is set to be sentenced later this year, facing a maximum prison time of 25 years and significant fines.

Despite the severity of the charges, Biden being a first-time offender makes it unlikely that he will receive the maximum penalties at sentencing.

Overall, the legal proceedings surrounding Hunter Biden's firearm purchase and subsequent conviction have garnered significant attention and scrutiny.
