The House Judiciary Committee has filed a lawsuit against Attorney General Merrick Garland to obtain audio recordings of President Biden's interview with Special Counsel Robert Hur. The committee emphasized the importance of the verbal and nonverbal context of Biden's answers, especially since Hur chose not to charge Biden after the interview, citing his age and memory.

Amidst Democratic Party turmoil over Biden's debate performance, the committee challenges Biden's executive privilege claim on the recordings, arguing that they are crucial evidence. The Justice Department provided transcripts but withheld the audio recordings, prompting the committee's legal action.

The committee asserts that the recordings offer a more comprehensive understanding of Biden's demeanor during the interview, which influenced Hur's decision not to prosecute Biden for mishandling classified information. The lawsuit aims to overrule Biden's privilege claim and obtain the recordings for assessment.

Despite the House holding Garland in contempt for defying subpoenas, the Justice Department declined to prosecute him. Hur's investigation, which concluded without recommending charges against Biden, involved sensitive classified documents related to national security and foreign policy.
