HC stays cancellation of RAS prelims results on Rajasthan Public Service Commission plea

JAIPUR: The division bench of the high court on Wednesday stayed the single bench order cancelling the RAS Prelims results on an appeal by Rajasthan Public Service Commission. The court said the RPSC could go ahead with the main examination.

The bench of chief justice Akil Kureshi and justice Sudesh Bansal while staying the single bench order directed the respondents to file their replies within four weeks. Advocate general Mahendra Singhvi assisted by RPSC counsel Amit Lubhaya argued the case in the two-hour-long hearing in the court.

Lubhaya said with the staying of the single bench order, now the results announced by the RPSC has been revived.

Singhvi argued that the RPSC issued the final answer key after inviting objections and the objections were examined by an expert committee.

Quoting the Supreme court order in the Ran Vijay Singh, Rahul Singh and Vikesh Gupta case, Singhvi argued that according to the apex court order, the high court could not act as an appellate authority on an expert committee.

He argued that in case of doubt on any question, the benefit should go to the examiner rather than the examinee.

In a major setback to the state government, the high court on Tuesday cancelled the RAS preliminary exam results. The court, while deleting one disputed question, referred four other questions to another expert committee. The RPSC was directed to constitute the committee to finalize answers to the four questions, based on which the revised merit will be declared.

The single bench gave the order while deciding on a bunch of petitions challenging about a dozen questions. The court rejected objections to other questions. The RAS main exam scheduled to be held on February 25-26 was cancelled by the RPSC following the single bench order.
