Granny suing Aldi says she had 'breakdown after fracturing arm on shopping trip'

A granny claims she's suffered years of agony after being injured during a shopping trip to Aldi.

Phyllis Middlemass says she suffered a broken arm, fractured wrist and a head injury after colliding with a pallet forklift being pulled by a member of staff.

The 60-year-old wants to sue the supermarket chain claiming she's endured physical and emotional suffering following the incident at the Johnstone branch, the Daily Record reports.

The grandmother of 11 insists she has been left unable to do simple tasks as a result of injuries she says were caused during the incident.

Phyllis suffers from fibromyalgia and is registered disabled, she has metal plates in her leg after suffering a break four years ago.

She claims: "It’s really affected my mental health. I had a breakdown because of this.

“I was just getting round to getting back out after the leg break and this has really affected my confidence and made me really depressed.

“I can’t wash my hair and I can’t put my bra on properly anymore, it’s too painful.

“I need my daughter to do all these things for me.

“I can’t cook properly now.

“I had a chicken on and didn’t have the strength to lift it. I dropped it all over the floor.

“I used to go swimming all the time with my grandkids, but I can’t do that anymore.

“My older grandkids help me as much as possible.

“My whole family has been great, and if I didn’t have them I don’t know what I’d have done.”

Now she wants to retain a new lawyer to take on her legal case.

The incident took place in October 2019, while she was shopping with her daughter Lynne, 40.

She said: “I don’t remember what happened.

“My daughter said I was walking and the girl came out of the storeroom pulling a pallet forklift and walking pretty fast.

“I was taken right off my feet and fell at Lynne’s feet. The next thing I know I was in the ambulance going to the hospital.”

Phyllis said two previous law firms dealt with the case for her, but that she is now looking for someone else to represent her.

She said: “It was with a solicitor and they said it was a 50-50 because nobody was accepting responsibility for causing it.

“There were witnesses and CCTV evidence. My daughter saw the whole thing and the shop was busy with customers and kids - it was a Friday afternoon during the school holidays.

“I’m still on morphine, still having to attend the hospital and still getting work done on my arm.

“I’m trying to get another solicitor now to take it on. This is my life and I’ve been left in constant pain and having to take morphine every day just to get by.

“I’m left with these injuries through no fault of my own.

An Aldi spokesperson said: “We are not in a position to comment as it is an ongoing legal matter.”
