Gauhati HC denies bail to youth held for supporting Ulfa

GUWAHATI: The Gauhati High Court recently denied bail to a 24-year-old UAPA accused, who allegedly propagated ULFA (I) ideology on Facebook.

High court Justice Kalyan Rai Surana, in his order on Monday while hearing the bail petition of Abhijit Gogoi, stated "On perusal of the case diary, it is seen that the mobile phone of the petitioner was seized and the investigation carried out so far implicates the petitioner of making objectionable posts propagating the ideology of the banned organization, which was uploaded by the petitioner in his Facebook account."

The court added, "Accordingly, the court prima facie finds that the action of the petitioner would fall within the meaning of Section 39 of the Unlawful Activities (Prevention) Act, 1967. Therefore, the court would be bound by the proviso to section 43D of the Unlawful Activities (Prevention) Act, 1967. Therefore, there is no material by virtue of which the court can arrive at a prima facie finding that on perusal of the case diary, it can be believed that the acquisition against the petitioner is untrue."

Gogoi was arrested on June 4 by Dispur police. His counsel submitted before the court that he was only a 24-year-old boy, who did not know the implications of sharing the post on the social media.

The public prosecutor, while opposing the prayer for bail, submitted that the investigation carried out so far implicates the petitioner of sharing comments in favour of the banned organisation on the social media platform and thereby the petitioner was propagating the ideology of the banned organization and was writing in support of it.

On the other hand, a 23-year-old girl and a promising wushu player, Pranita Chutia, who was arrested by Sonari Police on June 17 after she posted a comment on the social media supporting the banned outfit, was released from judicial custody on bail by Charideo district court on Friday.

In another case, the Gauhati HC on July 21 granted bail to Barshasri Buragohain, a student who was in jail in Golaghat district since May 18 for writing a poem allegedly calling for rebellion against the nation.
