Former NRL player Teui 'TC' Robati is due to decide how he will respond to a sexual assault charge after mediation with prosecutors broke down.
Robati, who was cut by Brisbane Broncos last year, has been accused of assaulting a female patron at a Brisbane bar on December 21, 2022.
The case was due to be mentioned in Brisbane Magistrates Court on Friday but neither Robati nor his legal representative attended.
Police prosecutor Michael Colclough told the court that mediation with Robati was not proceeding.
Magistrate Andrew Moloney asked if the case would continue as a summary or an indictable matter, the latter of which being more serious and requiring a higher court.
"It depends whether he pleads guilty or not," Senior Constable Colclough replied.
Mr Moloney said notice would be sent to Robati's legal representative and the matter would be adjourned until February 14 with his release on bail to continue.
Robati could enter a plea next month or the case could move to a committal process to determine whether there is sufficient grounds to take the matter to trial in the District Court.
New Zealand-born Robati could play as a second-rower or as a middle forward and impressed in his debut season of 2021, appearing in 10 NRL games.
His form was not as strong in 2022 where he made just seven top-grade appearances after playing for the Maori All Stars.
He was axed by the Broncos in February 2023 before the season kick-off.
