Former CJI Dipak Misra copy-pasted 212 of 451 paras in order, says Singapore top court

The Singapore Court of Appeal has set aside an international arbitral award involving a government railway contract after finding that the award had significant portions that were “copied and pasted” from two similar Indian arbitration awards.

“Out of the 451 paragraphs in the award, it was undisputed that at least 212 paragraphs were copied and pasted from the parallel awards,” the order noted on Tuesday. Parallel Awards is a reference to two Indian arbitrations that were held parallel to the Singapore arbitration involving the same parties.

The presiding arbitrator in all three awards was former Chief Justice of India Dipak Misra, said the 40-page order.

The Court of Appeal is the highest court in Singapore.

The dispute, involved a special purpose vehicle set up to manage a network of Dedicated Freight Corridors in India, and a consortium of three companies which was awarded a tender in 2014 to manage the western Dedicated Freight Corridor.

In December last year, the Bengaluru bench of the Income Tax Appellate Tribunal passed an order citing three Supreme Court judgments and one Madras high court judgement that do not exist. The order was withdrawn within a week citing “inadvertent errors”.
