Father and son suffer serious injuries after confronting youths

A father and son suffered serious facial injuries after they confronted a group of youths in a Hamilton street.

The dad, then aged 40, was punched, kicked and stamped on and struck with a metal pole while his son ,19, was also punched and kicked.

Gary Allan, 18, of Whistleberry Crescent, and a 17-year-old male - who is too young to be named - appeared at Hamilton Sheriff Court this week.

They admitted assaulting the 40-year-old to his severe injury, permanent impairment, permanent disfigurement and the danger of his life in Margaret Road on January 9 last year.

The pair also admitted assaulting a teenager to his severe injury and permanent disfigurement.

A third accused, David McKinnon, 19, of Whistleberry Drive, had his not guilty pleas to the charges accepted.

The court heard that Allan and the younger youth had been looking for their teenage victim that evening and went to his home at 10.30.

He wasn't there at that time but did return shortly afterwards.

Jennifer Cunningham, prosecuting, said the father and son left the house at 11pm and drove to Margaret Road. The dad had armed himself with an iron bar.

They got out of the car, with the father carrying the iron bar, and approached a group of youths that included the accused.

Ms Cunningham told the court: "A large scale fight broke out and this was captured almost in its entirety by CCTV cameras.

"During the fight one of the youths punched and kicked the son, causing him to fall. Whilst he was on the ground, Allan joined in the assault by punching and kicking him.

"The son then noticed that his dad was being assaulted by Allan and another male. He ran to help his dad but Allan again assaulted him by punching and kicking.

"Allan also kicked the father on the head and stamped on his ribs as he lay on the ground.

"The other accused then kicked the father twice on the body. The younger victim realised his dad was unconscious and dragged him back to their car."

The older of the victims suffered a double jaw fracture and underwent surgery at a specialist unit at Forth Valley Hospital in Larbert. This involved the removal of a tooth and insertion of three plates and 15 screws.

He also sustained five broken ribs and internal abdominal bleeding.

The 40-year-old says that his right cheek is "completely numb" as a result of the facial injuries. He also has numbness in his chin and is undergoing dental treatment.

His son sustained a broken nose and a broken tooth as well as cuts and bruises.

Defence agent Archie Hill said the trouble seemed to stem from the two accused and another youth going to the victim's home to complain about a near miss caused by his driving earlier in the evening.

Sheriff Andrew McIntyre, who viewed the CCTV footage of the attack, continued the case until next month for background reports.

Both accused, who have no previous convictions, were allowed to remain on bail, but the sheriff told them:

"These are very serious charges, about the most serious that come before the sheriff court.

"I must consider all the sentencing options that are open."
