Family dispute leads to Lanarkshire woman smashing up relative's Mercedes

A family dispute led to a woman smashing up a relative’s Mercedes with a metal pole.

At the same time Colleen Berry was demanding that the frightened occupant get out of the car and fight.

The 36-year-old and her cousin, Ryan McFarlane, 29, both of Curlinghaugh Crescent, Wishaw, appeared at Hamilton Sheriff Court.

They admitted threatening or abusive behaviour towards a man and a woman in Rannoch Drive, Wishaw, on June 10, 2019.

Berry also admitted maliciously damaging the bodywork and windscreen of the Mercedes.

Alice Carey, prosecuting, said it happened about 3.40pm when the couple topped at a junction. They became aware of a Renault Megane pulling up alongside them.

The fiscal stated: “Berry, who was in possession of a metal pole, got out of the vehicle, followed by McFarlane.

“She approached the other car, shouting 'Get out. Do you want a fight?’

“Berry was brandishing the pole and the witnesses stayed in their car, fearing for their safety.

“Berry then struck the Mercedes with force, causing dents in the bonnet and front passenger door and smashing the windscreen.

“McFarlane was shouting, swearing and kicking the vehicle.”

Eventually the couple were able to drive off and the police were contacted.

McFarlane was jailed for 13 months in May for his part in the incident.

Berry returned to court for sentence this week.

Defence agent Andy Thomson said she was a “genuine first offender”.

He added: “This case revolves around a family dispute. There was a chance meeting and she acted in this way.

“It’s more than three years ago now and there has been no offending since.”

Sheriff Liam Murphy told Berry: “This must have been extremely frightening for the occupants of the vehicle.

“However, the criminal justice social work report is positive so I shall follow its recommendation and impose an alternative to custody.”

Berry was ordered to do 180 hours of unpaid community work within 12 months.
