Duo jailed after being involved in theft from Lanarkshire tower block flat

Cash, a phone and a games console were stolen from a man’s flat in a row over drugs.

John O’Rourke, 56, and David Weir, 37, both prisoners, were each jailed for five months at Hamilton Sheriff Court.

They admitted involvement in the theft from Dalziel Tower, Motherwell, on Christmas Day last year.

An allegation that they assaulted the male householder by pursuing him, holding him down and hitting him on the head with a hammer before robbing him was dropped.

Paul Jamieson, prosecuting, said CCTV showed the accused and another man going into the flat and leaving half an hour later carrying two bags.

Police officers confronted them near O’Rourke’s home in Alexander Path, Motherwell.

Weir was carrying the stolen phone and the other items were recovered from O’Rourke’s address.

O’Rourke told officers: “It was all over money for drugs.”

He also admitted breaching a bail curfew while Weir admitted possessing heroin.

Defence agents said the accused had been held in custody since their arrest.

They had pleaded guilty to a charge that had been reduced significantly from assault and robbery to theft.

Sheriff Liam Murphy jailed each man for five months but backdated the sentences, allowing them to go free immediately.
