Drunk guest hits grieving daughter after he broke heirlooms at her dad's funeral

A mourner who attacked a grieving daughter after she challenged him about his rowdy behaviour during the funeral has been jailed for six months.

Kevin Spokes, 36, from Dundee, had been in a drunken state during the funeral, which cumulated with him staggering into several heirloom vases and smashing them.

When the daughter of the deceased tried to stop him, he attacked her.

Dundee Sheriff Court was told that Spokes suffered from "karma" when he fell off his bike and suffered injuries as he tried to flee from the scene.

Sheriff Gregor Murray said: "I take into account that these were bad crimes. You had a record for domestic offending, albeit ten years before."

He jailed Spokes for six months and confirmed that he was subject to a non-harassment order for a two-year period.

Spokes was the only person injured after he carried out attacks on the dead man's daughter and another female.

The court was told that Spokes sparked a furious row after staggering into and breaking vases bequeathed to the woman.

Fiscal depute Michael Sweeney said: "There was a family funeral and the accused had consumed a large quantity of alcohol.

"He began arguing with [her]. He dragged her by the shoulders through the living room, threw her to the ground and punched her head.

"The accused picked up a chair and threw it. It struck [her] to the body and hit the other complainer on the head.

"They all ran out into the garden. Police were contacted and the accused ran off. Everyone was in a state of distress."

Solicitor Andrew Lyall, defending, said: "He is truly sorry about his behaviour that day. They had been in a relationship for around seven years.

"The morning of the day after her father's funeral did not start well. He had consumed a considerable amount of alcohol and that was still bubbling about in him the following morning.

"Because of his unsteadiness he caused the breakage of vases gifted to her upon the passing of her father, and not surprisingly, this caused acrimony.

"He took his frustration out on the furniture. He had been at the funeral and became intoxicated and the matters before the court happened.

"His phone rang too and it was another female. The only person who was ultimately injured was himself. He decided to make off on a bicycle.

"He fell off it because he was drunk. He split his head open, ended up in hospital with six stitches, so karma had intervened."

Spokes, of Ballantrae Road, Dundee, admitted assaulting his victim by punching her head and body and throwing a chair at her on 9 June 2021.

The 36-year-old also admitted assaulting another female by throwing a chair at her and striking her on the head in Inveresk Gardens.

Sheriff Murray said: "This was an appalling offence. You have a record for domestic offending. Social work have concerns you might continue to reoffend."
