Delhi Police To Court: FIR against ex-CM Kejriwal, two others; But why...

New Delhi: The Delhi Police on Friday told a court that they have registered a case against former Chief Minister Arvind Kejriwal on March 26 for the alleged misuse of funds in putting up “illegal” hoardings in Dwarka, reports Dynamite News correspondent.

The case is the damage to public property in Dwarka area in 2019. It is alleged that during that time illegal posters and banners were put up at public places, which violated the Defacement of Public Property Act. On the basis of this complaint, the court had directed the Delhi Police to register an FIR on 11.

Compliance Report 

Delhi Police submitted the compliance report in the court of Additional Chief Judicial Magistrate (ACJM) Neha Mittal and informed that the FIR has been registered.

On March 11, the Rouse Avenue Court Additional Chief Judicial Magistrate (ACJM) Neha Mittal had asked the Police to file an FIR against Kejriwal and also against former AAP MLA Gulab Singh and the then Dwarka councillor Nikita Sharma.

The Petitioner 

The case was filed by Shiv Kumar Saxena who had alleged that the former CM during his tenure was “misusing public money by putting huge size hoardings” in various places at Dwarka.

ACJM Observation

The ACJM Neha Mittal said in her 11 March verdict, “The seriousness of the offence… can be gauged from the fact that it is not only an eyesore and public nuisance, thereby destroying the aesthetic sense of the city, but is also hazardous… to the smooth flow of traffic by distracting traffic and poses a safety challenge to pedestrians and vehicles. Deaths caused by the collapse of illegal hoardings are not new in India.”

The ACJM ordered the SHO concerned to file the FIR under Section 3 (penalty for defacement of property) of the Delhi Prevention of Defacement of Property Act (DPDP Act), 2007, and for “any other offences that appear to have been committed from the facts of the case”.

The Court had also earlier ordered an FIR against Ex-AAP MLA Gulab Singh and then Dwarka councillor Nitika Sharma.

Next hearing will be on April 18.
