A lout who shouted and swore near children playing in a Perthshire park during an altercation with his girlfriend then headbutted her at a birthday party has been banned from leaving his house at night for five months.
Perth Sheriff Court heard last week the woman was at Balmanno Play Park in Bridge of Earn with children one afternoon in July last year when Duncan McPhee turned up in a vehicle at around 4.40pm then started shouting and swearing at her and demanding she hand over £200.
“The complainer refused to provide the sum of money and asked the accused to leave the park,” fiscal depute Elizabeth Hodgson told the court.
“The accused shouted [slurs]. The accused then returned to his vehicle and left the locus.”
Ms Hodgson said a little over two months later the woman was at a birthday party at a house McPhee when he started hurling abuse at his hosts.
“The accused was in attendance and had been drinking,” Ms Hodgson told the court.
“Due to his intoxication he began shouting abuse at the family. Witnesses attempted to calm the accused down and contacted the accused’s father.”
Ms Hodgson said as his girlfriend tried to get him in a car to be taken away he then grabbed hold of her and headbutted her.
“The accused grabbed the complainer and headbutted her on the forehead,” she said. “This was to her injury. She required no medical treatment but did have a bump on her forehead.”
McPhee (35), of Smillie Place, Bridge of Earn, pled guilty to behaving in a threatening or abusive manner likely to cause a reasonable person to suffer fear or alarm at Balmanno Play Park on July 1, 2021 by shouting, swearing and making abusive comments towards his partner.
He also pled guilty to assaulting his partner on September 25 last year by striking her head with his head to her injury.
Sheriff Craig McSherry imposed a restriction of liberty order on McPhee under which he is not allowed to leave his home address between the hours of 7pm and 7am for the next five months.
