Crime Scene Technician Testifies About Altered Firearm In Court

In a recent court hearing, crime scene technician Marissa Poppell provided crucial testimony regarding Exhibit #6, which was identified as the weapon taken from Lt. Timoteo Benavidez’s vehicle.

Poppell described the weapon to the jury, highlighting that it was presented in a box with parts stored in separate plastic bags attached with zip ties. She mentioned that she had requested the gun to be tested by FBI analysts for latent fingerprints, which are not visible to the naked eye. Additionally, Poppell testified that she had requested a firearms functioning test to ensure the weapon was in proper working order.

However, Poppell revealed a surprising development in her testimony. She stated that when she sent the firearm to the FBI, it was intact. Yet, upon receiving it back, she noticed significant changes in its condition. Specifically, the cylinder of the firearm had been removed and placed separately, along with an internal component that was bagged in a small plastic bag separate from the firearm.

This unexpected alteration in the firearm's condition raised questions during the court proceedings, prompting further investigation into the handling of the weapon. Poppell's testimony shed light on potential discrepancies in the handling and examination of the crucial piece of evidence in the case.
