Conservative influencer sues Elon Musk for paternity test after claiming he is the father of her baby son

Elon Musk is being sued by a Conservative influencer who is demanding a DNA test after claiming he is the father of her five-month-old son.

Ashley St. Clair, 26, filed a petition with the New York Supreme Court on Friday, February 21, saying the Tesla CEO and DOGE Chief has played no role in raising her son.

She has also filed a second lawsuit seeking a paternity test since “the father of the subject child has not been legally established,” Mail Online reports.

The child would be Musk's 13th if his paternity is established.

St. Clair says Musk, 53, 'slid into my DMs' in May 2023, and later that month she met him as he was being interviewed by her then-boss Seth Dillon, CEO of right-wing news site Babylon Bee in San Francisco.

St. Clair says in her submission that they embarked on a romantic affair soon after meeting and she believes her son was conceived on the Caribbean island of St Bart's. The child was born in September 2024 and Musk was not present at the birth.

Since then, St. Clair says Musk has shown no interest in having custody and has only seen the baby on three occasions.

In the filing, she states: "I am not currently married to Respondent or any other person. I did not have sexual intercourse with any other male during the time the child was conceived.

"I am requesting an order for genetic testing to determine the paternity of the child."

St. Clair adds that she wishes for sole legal and physical custody of her son. She says Musk saw the child on September 21 last year in New York, where she lives, for two hours, followed by a one-hour visit the next day. Musk last saw St. Clair and her son in Austin, Texas, for two hours.

St. Clair announced the birth of her baby boy in an Instagram post on Valentine's Day: "Five months ago, I welcomed a new baby into the world. Elon Musk is the father.

“I have not previously disclosed this to protect our child’s privacy and safety, but in recent days it has become clear that tabloid media intends to do so, regardless of the harm it will cause.

“I intend to allow our child to grow in a normal and safe environment. For that reason, I ask that the media honor our child’s privacy, and refrain from invasive reporting.”

Musk has not publicly commented on St. Clair's claims, but he did respond on X to a follower who joked that making "another baby" was one of Musk's "side quests". Musk replied with a crying laughing emoji.
